These commodities were selected based on a thorough Impact Assessment, scientific data, and research, highlighting the significant contribution of European production and consumption to global deforestation. The list of regulated products is detailed in Annex I of the Regulation, and it is subject to regular reviews and updates to adapt to changing deforestation patterns.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-949b280 elementor-widget elementor-widget-heading\" data-id=\"949b280\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Annex I and Product Coverage<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6528088 elementor-widget elementor-widget-text-editor\" data-id=\"6528088\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Products listed in <a href=\"https:\/\/health.ec.europa.eu\/system\/files\/2020-02\/2020_annex1ps_sterile_medicinal_products_en_0.pdf\">Annex I<\/a> are subject to the Regulation, irrespective of their origin. This even-handed approach ensures no discrimination between EU-produced and imported goods. Products not listed in Annex I are exempt, even if they contain relevant commodities. The obligations vary for Small and Medium-sized Enterprises (SMEs) and larger entities.<\/p><p><strong>Non-SME Operators:<\/strong><\/p><ul><li>Must verify due diligence was performed earlier in the supply chain.<\/li><li>Retain legal responsibility for any breaches of the Regulation.<\/li><li>Required to submit a due diligence statement in the Information System.<\/li><\/ul><p><strong>SME Operators:<\/strong><\/p><ul><li>Subject to similar obligations as non-SME operators but with some simplifications.<\/li><li>Must provide due diligence reference numbers from earlier supply chain steps.<\/li><li>Required to perform full due diligence and submit a statement for parts not previously checked.<\/li><\/ul><p><strong>Non-SME Traders<\/strong><\/p><p>Non-SME traders, such as large supermarket or retail chains, have obligations similar to large downstream operators. They must:<\/p><ul><li>File a due diligence statement.<\/li><li>Ensure compliance with the Regulation, even if relying on due diligence carried out earlier in the supply chain.<\/li><li>Be liable for any breaches, including those from upstream operators.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e637e5 elementor-widget elementor-widget-heading\" data-id=\"6e637e5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Specific Scenarios and Applications <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1c72c38 elementor-widget elementor-widget-text-editor\" data-id=\"1c72c38\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Standing Trees and Harvesting Rights<\/strong><\/p><p>The EU Deforestation Regulation applies at the moment of harvesting. The &#8216;operator&#8217; could be the forest owner or the company with harvesting rights, depending on who places the relevant product on the market or exports it.<\/p><p><strong>Exports and Commercial Activity<\/strong><\/p><p>The Regulation applies to both imports and exports. Operators must include the due diligence statement reference number in export declarations and can use simplifications if the commodities have already been covered by due diligence.<\/p><p><strong>CN and HS Codes<\/strong><\/p><p>The Combined Nomenclature (CN) and Harmonized System (HS) codes are used to classify goods under the Regulation. Annex I products are classified using CN codes, which are essential for import and export declarations within the EU.<\/p><p><strong>Packaging, Recycled Materials, and Natural Disasters<\/strong><\/p><ul><li><strong>Packaging<\/strong>: Only standalone packaging is covered by the Regulation. Packaging supporting other products is exempt.<\/li><li><strong>Recycled Paper\/Paperboard<\/strong>: Exempt if produced entirely from recycled material. If containing non-recycled material, due diligence is required.<\/li><li><strong>Natural Disasters<\/strong>: Deforestation includes human-induced and natural conversions of forest to agricultural use.
