Commission Implementing Regulation (EU) 2024/3126 repeals the earlier Implementing Regulation (EU) No 385/2013 and reclassifies facial wipes to align with the World Customs Organization’s (WCO) new classification opinion.

The old classification (CN Code) was 3304 99 00 – Preparations for the care of the skin (other than medicaments). The new classification (CN Code) is 3307 90 00 – Cosmetic or toilet preparations, including nonwovens impregnated with perfume or cosmetics.

The reclassification ensures that these products are treated as cosmetic preparations, aligning with international standards, and reducing potential trade barriers. The effective date was January 4th, 2025.

EU Product Classification Regulations: Key Points of EU Regulation 2024/3133 for Product Classification

Commission Implementing Regulation (EU) 2024/3133 ensures the uniform application of the Combined Nomenclature (CN) for classifying goods. It assigns CN codes to specific goods and allows the use of non-conforming binding tariff information (BTI) for up to three months after its effective date.

For example, beanbag covers without filling material are classified under CN code 6307 90 98 as “other made-up textile articles,” excluding them from being considered as seating (CN 9401), bedding or similar furnishings (CN 9404), or bed linen (CN 6302).

BTI provides businesses with certainty about the correct tariff classification of their goods, and this transitional period allows them to adjust to the new requirements. The effective date was January 5th, 2025.
